一、 補業績計劃
I. The Performance Supplement Scheme
1. 公司推出補業績計劃，將精選的數種公司產品以組合形式銷售，套餐內容由公司不定时公布，供各獨立經銷商選購。
The Company has launched the Performance Supplement Scheme, which provides combinations of various selected products of the Company, the content of which is published by the Company from time to time for purchase by independent distributors.
2. 補業績套餐的價格及套餐中的產品種類、數量由公司全權決定及不時更改，你無權要求對套餐內容作更改或調整。
The price of the Performance Supplement Sets and the type and quantity of the products therein are decided and may be varied from time to time at the Company’s sole discretion. You do not have the right to request for any variation or adjustment to the content of the Performance Supplement Sets.
二、 訂單及付款

1. 你於本網站下訂單，即視為你明確同意本條款及細則所有內容。
By placing order on this website, you are assumed to have expressly agreed to all contents of these Terms and Conditions.
2. 本條款及細則內的信息和本網站所列出的產品資料並不構成法律上的要約，而是要約邀請。你所下的訂單將被視為你向公司提出的要約。
The information in these Terms and Conditions and the product details listed on this website constitutes an invitation to treat but not a legal offer. Any order placed by you will be regarded as an offer from you to the Company.
3. 任何訂單不得取消、轉讓或兌換現金。
Any placed order cannot be cancelled, transferred, or exchanged for cash.
4. 你的訂單可能受倉庫供應情況及套餐內容變動影響。購物車中的套餐不設預留, 而且有可能被其他獨立經銷商購買.
Your order may be affected by availability of the relevant products at the warehouses or variation of content of the Performance Supplement Sets. The Sets added in your shopping cart are not reserved and may be purchased by other independent distributors.
5. 本網站只接受VISA或萬事達信⽤卡及銀聯卡付款。
This website only accepts payment by Visa or MasterCard credit cards or UnionPay cards.
6. 在本網站以信用卡或轉帳卡付款, 即表示你確認你為該信用卡或轉帳卡的持有人, 或獲得持有人授權付款。
By payment with credit card or debit card on this website, you confirm that you are the holder of the said card or are authorized by the holder to make payment with the same.
7. 提交訂單後須保留購貨發票或二維碼作為提貨憑證。
After placing the order, you shall duly keep the invoice or QR code as document proof for collection or exchange of the products.
三、 提貨
III. Product Collection
1. 你應於下訂單後60日內在公司辦公時間前往公司指定地點提取購買的產品。如有遲延提貨，公司有權向你收取額外存倉費。
You shall collect the purchased products at the venue designated by the Company and at the office hours of the Company within 60 days upon placing your order. The Company is entitled to charge you for extra storage fee if there is any delay in collection:-
(1) 若產品在下訂單後60日內仍未被提取，公司將收取港幣100元存倉費；
If the products are not yet collected within 60 days from placement of order, the Company will charge HK$100 storage fee;
(2) 若產品在下訂單後180日內仍未被提取，公司將收取港幣300元存倉費；
If the products are not yet collected within 180 days from placement of order, the Company will charge HK$300 storage fee;
(3) 若產品在下訂單後365日內仍未被提取，公司有絕對權利自由處理產品，包括將其轉售或銷毀，並保留權利向你追討相應的存倉費用。
If the products are not yet collected within 365 days from placement of order, the Company shall have absolute discretion to deal with the products, including re-selling or destroying the same, and the Company shall reserve its rights to claim the relevant storage fee from you.
2. 你必須憑購貨發票或二維碼取貨，遺失購貨發票或二維碼而無法取貨的損失將全部由你自理。
You shall produce the invoice or QR code for collection of the products. Any loss incurred by failure to collect the products because of your loss of the invoice or QR code will be solely borne by yourself.
3. 你應一次性提取購買的套餐內的所有產品，不可分批提取。你的購貨發票或二維碼將在第一次提貨後自動失效，不得重用，而公司有絕對權利自由處理尚未提取的產品。
You shall collect all products in the purchased Set at one time but not in batches. Your invoice or QR code will be automatically disabled after your first collection of products and cannot be re-used, and he Company shall have absolute discretion in dealing with the uncollected products.
4. 在不影響上述第1條內容的普遍性的情況下，如本網站已標明某些產品的最佳使用期，你應確保在該最佳使用期前提貨，否則公司將不為過期產品負任何責任，亦不會僅因產品過期而為你退換產品。
Without limiting the generality of Clause 1, if this website has provided the best-before date for certain product in the Set, you shall assure that you collect the products before the said best-before date, otherwise the Company shall not be liable in any event for such expired product, nor shall it arrange refund or exchange of products for you solely because the product has expired.
5. 如網站未标明產品的最佳使用期，你應按照上述第1條內容於下訂單後60日內提貨。如因你遲延提貨導致任何產品在提貨時已過期，公司將不為過期產品負任何責任，亦不會僅因產品過期而為你退換產品。
For those products of which no best-before date is provided on this website, you shall collect the products within 60 days of placing the order pursuant to Clause 1 above. If any product has expired upon your collection because of your delay in collection, the Company shall not be liable in any event for such expired product, nor shall it arrange refund or exchange of products for you solely because the product has expired.
四、 產品退換
IV. Product Return and Exchange
1. 所有補業績套餐售出的產品均不接受任何形式之退款，包括現金或信用卡之退款。
No refund is available for the products sold under the Performance Supplement Sets, including refund by cash or credit card.
2. 除非產品在提貨時已有嚴重損壞，所有補業績套餐售出的產品均不接受換貨。
Unless the product is seriously damaged at the time of collection, no exchange of products is available for the products sold under the Performance Supplement Sets.
3. 受限於上述第2條規定，如產品需要換貨，將由公司全權決定更換的產品。所有產品只可更換一次，已換之產品亦不可再次更換。另外，你必須：
Subject to Clause 2 above, if exchange of products is required, the Company will have the sole discretion to decide the product to be exchanged. All products can only be exchanged once and products obtained through exchange cannot be exchanged again. Further, you shall also:-
(1) 在提貨7個工作日內向公司提出換貨申請（遲延提出的申請公司將不予受理）；
submit any request for exchange of product to the Company within 7 days from collection of the product (any late request will not be accepted);
(2) 確保退還的產品未經使用、完整無缺、未曾開封，且妥善放置於未受損壞的原裝包裝盒及包裝袋；
ensure that the returned product is unused, intact, unopened and properly placed in the undamaged original packing box and bag;
(3) 在換貨時出示購貨發票或二維碼，并提供證據證明產品在提貨時已經嚴重損壞；
produce the invoice or QR code, and evidence that the product has already been seriously damaged at the time of collection when exchanging the product;
(4) 如公司決定為你更換的產品價格高於退還產品的價格，以現金即時向公司補足差額；如公司決定為你更換的產品價格低於退還產品的價格，放棄索要差額；及
if the product to be exchanged as determined by the Company is higher in price than the returned product, pay up the difference to the Company immediately in cash; or if the product to be exchanged as determined by the Company is lower in price than the returned product, waive your claim for the difference; and
(5) 自行負擔因換貨產生的額外費用（交通費等）。
bear any extra costs incurred by the exchange of products (e.g. transport).
五、 知識產權
V. Intellectual Property
1. 公司對本網站及本網站上的所有內容均享有知識產權（包括但不限於版權、商標、專利、技術或任何其他知識產權）。本條款及細則中的任何內容均不構成對公司任何知識產權的轉讓或授權使用。

Nothing in these Terms and Conditions shall constitute the assignment or authorization to use any intellectual property right of the Company.
2. 本網站只供作個人及非商業用途。未經公司書面明確授權, 嚴禁以任何方式（包括但不限於發佈、複製、發佈、售賣或特許）使用本網站的內容作任何非個人或非商業用途。上述任何未經授權的行為均可能導致民事後果或刑事處罰。

Unless expressly authorized by the Company in writing, you shall not use in any way (including but not limited to distributing, reproducing, publishing, selling or licensing) any content of this website for any non-personal or non-commercial use. Any such unauthorized actions as abovementioned may incur civil consequences or criminal penalties.
六、 賠償及豁免
VI. Compensation and Waiver
1. 你同意向公司全數賠償因你任何違反條款及細則的行為所致的所有責任、索賠、費用、損害和損失, 包括律師費。這包括任何第三人因你的行動或沒有行動而利用你的帳戶使用本網站的情況。
You agree to fully compensate the Company for all liabilities, claims, expenses, damages and losses, including legal fees, incurred by any breach of these Terms and Conditions by you. This includes the use of this website by any third party using your account which is caused by your action or inaction.
2. 如果你違反本條款及細則而公司未對你的行為採取行動, 並不代表公司放棄在其他你違反本條款及細則的情況下享有的權利和補償。
Inaction of the Cmpany in the circumstances where you have breached these Terms and Conditions does not constitute the Company’s waiver of its rights and remedies in any other circumstances of your breach of these Terms and Conditions.
3. 你同意公司免于承担任何直接或間接使用本網站所引起的責任、索賠、費用、損害和損失。在任何情況下，本網站所引起的任何直接、間接、附帶、懲罰性、特殊或後果性的損害賠償，包括但不限於本網站內容中的任何錯誤或遺漏及由於使用本網站所示的產品發生的任何損失或損害，公司均不會為此承擔任何責任。
You agree to hold the Company harmless from any liabilities, claims, expenses, damages and losses directly or indirectly incurred by use of this website. The Company shall not be liable in any circumstances for any direct, indirect, incidental, punitive, special or consequential damages incurred by this website, including any error or omission in its contents or any loss or damage arising from use of any product posted on this website.

You undertake that you will and you assure that any third party will follow the instructions in the product specification when using the Company’s products that you purchased. You are aware of the fact that some people may be allergic or intolerant to certain ingredients in some product in the Set (for example, foods or aroma products). You agree, understand and confirm that it is your duty to ascertain whether the Company’s products you bought may cause harm to the users. No liability whatsoever shall be claimed against the Company, its directors, officers and agents as a result of any death or personal injuries arising out of or in connection with the use of the Company’s products sold in the Sets.
七、 管轄及法律
VII. Jurisdiction and Governing Law
1. 本條款及細則受香港特別行政區法律管轄，應根據香港特別行政區法律詮釋。如有任何與本條款及細則相關的爭議或索賠, 香港特別行政區的有關法院有專屬管轄權。
These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Hong Kong SAR. The relevant courts of Hong Kong SAR will have exclusive jurisdiction in the event of any dispute or claim associated with these Terms and Conditions.
